How to Enter: No purchase necessary. This sweepstakes begins on April 13th, 2009 at 9 a.m. E.T. and ends on June 1st, 2009 at 12 a.m. E.T. (the “Entry Period”). You can enter this sweepstakes by one of the following three means: Online entry: Enter by visiting Ghirardelli Chocolate Company's Online shop site during the Entry Period and filling out an entry form linked from that homepage. In-Store entry: Enter by visiting one of the participating Ghirardelli Ice Cream & Chocolate Shop locations and complete an entry form. View store locations here. Mail in entry: Hand print your name, address, home telephone number, email address and age on a 3”X 5” card and mail it to: Ghirardelli Chocolate Company, 1111 139th Avenue, San Leandro, CA 94578, ATTN: AMTRAK TRIP FOR 2. Only one entry per outer envelope. Mail in entries must be postmarked by June 1st, 2009 and received by June 11th, 2009. Only one entry per person.

Eligibility: This sweepstakes is open only to legal residents of the United States, 21 years of age or older at the time of entry. Residents of New York, Florida, Rhode Island and Louisiana are not eligible to enter. Online entrants must have email access as of April 13th, 2009. Employees and their immediate families, including household members, of Ghirardelli Chocolate Company and the National Railroad Passenger Corporation (Amtrak) (“Sponsors”), its parent, affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible.

Conditions of Entry: If you are entering online, you must be the registered subscriber of the e-mail account by which the entry is made prior to April 13th, 2009. Incomplete entries will not be accepted. All entries become the property of Sponsors By participating, entrants agree to these Official Rules, including all eligibility requirements. Neither Sponsors, nor their respective advertising and promotion agencies, nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmissions, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction, or late, lost, misdirected, illegible or postage due entries.

Prize: Grand Prize: One (1) round-trip for two in a Roomette on selected Amtrak long distance trains. The Grand Prize winner will receive round-trip tickets for two in a Roomette sleeping car to any destination of their choice on any one (1) of the following routes: Southwest Chief California Zephyr Sunset Limited Silver Service Empire Builder Crescent Cardinal, Coast Starlight, and City of New Orleans Second-place Prize: Four (4) second-place winners will receive round trip Coach tickets for two on selected Amtrak long distance trains .The second place winners will receive round-trip Coach tickets for two to any destination of their choice on any one (1) of the following routes: Southwest Chief California Zephyr, Sunset Limited, Silver Service, Empire Builder, Crescent, Cardinal , Coast Starlight, and City of New Orleans. There will be a total of five (5) winners. Values are approximate and range from $724 to $2,004 depending on route, type of service, date and time of travel. Fares, routes and schedules are subject to change. Transportation is not provided to or from train travel origination or debarkation points. Tickets are not good for stopovers, are non-transferable, and based on availability. No substitutions are allowed with these prizes. Travel must take place between Sept. 8, 2009 and May 21, 2010 observing the following blackout dates: Nov. 24-30, 2009; Dec. 17-23, 2009; Dec. 26-30, 2009; Jan. 3-4, 2010; Feb. 12 and 15, 2010; April 2, 2010; April -5, 2010.

Odds of winning are based on the number of entries received from online entries, in-store entries and mailed in entries. By accepting this prize, you consent to Sponsors’ use of your name and image for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. All taxes are the sole responsibility of the winner. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by Amtrak for reason of unavailability in which a prize of equal or greater value will be awarded. All prizes will be awarded.

Drawing: The prizewinner will be determined on or about June 13th, 2009 by a random drawing from all eligible entries received by the end of the Entry Period. The random drawing shall be conducted by an independent judge whose decisions are final with respect to all aspects of the sweepstakes. The winner will be notified by mail and email, if provided within 7 days of the drawing. The winner and a companion are required to sign an affidavit of eligibility/publicity and liability release, and return it properly executed within ten (10) days of attempted notification as a condition of awarding the prize. If prize notification is returned as undeliverable or the winner fails to return the affidavits and release as specified, the winner will be disqualified and the award will be forfeited. Amtrak is not responsible for technical, telephone, hardware or software malfunction, lost, interrupted, incomplete, garbled or delayed electronic communications, including the inaccurate or incorrect capture of online entry information, or any other errors of any kind, however caused, that may occur in the processing of the entries in this sweepstakes. If, in Sponsors’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with or alteration of any portion of the sweepstakes, or if any technical difficulties compromise the integrity of the sweepstakes, Sponsor reserves the right to terminate the sweepstakes or void any or all electronic entries. Persons entering via the web (Internet) must provide a valid email address. It is the sole responsibility of the entrant to notify the sweepstakes judges in writing if the entrant changes his/her email address after entering the sweepstakes. In case of dispute as to the identity of a winner who entered online, such entry will be declared made by the registered user of the email account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. Any attempt to deliberately damage the content or operation of this sweepstakes is unlawful and subject to legal action by Sponsors or its agents.

General: The sponsors of this sweepstakes are Ghirardelli Chocolate Company and Amtrak. This sweepstakes is subject to all federal, state, and local laws. Void where prohibited by law. The winner(s) agree(s) that Ghirardelli Chocolate Company and Amtrak, its affiliates and their agencies and employees shall not be liable for injury, loss or damage of any kind resulting from participating in this sweepstakes or from the acceptance or use of any prize awarded. Amtrak reserves the right to verify eligibility qualifications of any winner. U.S. law governs this sweepstakes.

Winners List: For the name of the winners, after July 1st, 2009, email sponsor at consumerresponse@ghirardelli.lindt.com, or send a self-addressed stamped envelope to Ghirardelli Chocolate Company, 1111 139th Avenue, San Leandro, CA 94578 and include the text: AMTRAK TRIP FOR 2 WINNER LIST. Requests received more than sixty (60) days after the completion of the entry period will not be honored.
